In a notable turn from his earlier strict immigration stance, Donald Trump has now recognised the importance of the H-1B visa Programme. He emphasised that America’s progress depends on welcoming global talent to drive innovation and strengthen national growth.

Background of H-1B Visa Programme

• About: The H-1B visa programme is one of the most significant pillars of the United States’ employment-based immigration system. It plays a vital role in attracting highly skilled professionals from across the world to meet the needs of the American economy.

• Purpose: The main purpose of the H-1B visa is to bridge the skill gap in the U.S. labour market by allowing employers to hire qualified professionals from other countries. The H-1B programme enables companies to bring in international specialists who can contribute to research, development, and innovation. The U.S. Congress created this visa under the Immigration Act of 1990, aiming to ensure that American industries remain globally competitive.

• Requirements: Applicants for the H-1B visa must possess at least a bachelor’s degree or higher in a field related to the job being offered. In specific cases, extensive professional experience may substitute for formal education if the candidate can demonstrate equivalent technical knowledge. The employer sponsoring the visa must provide evidence that the job requires specialized skills not easily found among U.S. citizens or residents. The company must also offer a salary that meets or exceeds the prevailing wage for that occupation in the region. 

• Application Process: The application process for the H-1B visa involves multiple stages and requires official approvals from U.S. authorities. First, the employer must submit a Labor Condition Application (LCA) to the Department of Labor (DOL). Once the LCA is certified, the employer files Form I-129. If this petition is approved, the candidate then goes through the interview round. 

• Benefits: It is typically granted for an initial period of three years, with the possibility of extension up to six years. H-1B holders are also permitted to bring their spouses and children under the H-4 visa category. Workers can even change employers if the new company files a valid petition with the USCIS. Major American corporations such as Google, Microsoft, Amazon, and Apple employ thousands of H-1B professionals.

These are areas where domestic talent may not be sufficient to meet industry demands. This programme helps maintain the global leadership of American companies in technology and research. Donald Trump’s Immigration Policies

• In January 2025 the Trump administration issued Executive Order 14159 titled “Protecting the American People Against Invasion”. The order expanded the use of expedited removal of undocumented immigrants and threatened to cut federal funding to sanctuary jurisdictions. It also introduced civil and criminal penalties for immigrants who failed to register when required.
• On June 4, 2025 President Trump signed Proclamation 10949 restricting the entry of foreign nationals from twelve designated countries. This proclamation was aimed at preventing individuals deemed a security risk or from “terrorist threats” from entering the United States. The policy extended his previous efforts to tighten external borders and entry controls.
• On September 19, 2025 Trump signed a proclamation titled Restriction on Entry of Certain Nonimmigrant Workers. This action required that employers pay a one-time fee of USD 100,000 for new H-1B visa petitions filed on or after September 21 2025. The policy applied only to petitions where beneficiaries sought entry into the U.S. under H-1B status and depended upon the effective filing date. 
• Alongside the H-1B overhaul, the Trump administration proposed to raise prevailing wage standards and to reform the H-1B lottery system so that employers would favour higher-paid foreign workers. The intention was to prioritise “the best and brightest” over entry-level skilled workers.

Reasons behind Trump’s New Approach toward Skilled Immigration

• Need for Global Talent: In November 2025 Trump publicly admitted that the United States “doesn’t have certain talents” and that the country must “bring this talent” to fill complex roles. He cited an example of a manufacturing plant where South Korean experts were needed to build batteries, emphasising that untrained or long-term unemployed Americans could not simply step into those roles.

• Economic Motivation: Trump’s administration linked the skilled immigration reforms that the H-1B programme had been “deliberately exploited” to replace U.S. workers rather than to supplement them. The H-1B programme has in some cases undermined wages and job opportunities for American citizens.

He emphasised that foreign professionals should be truly “the best and the brightest” and not simply fill low-wage positions.
