      • Individual penalties for general exam fraud increase to 5 to 10 years of imprisonment, plus fines up to ₹50 lakh.

Public Examinations (Prevention of Unfair Means) Act, 2024

  • About: The Public Examinations (Prevention of Unfair Means) Act, 2024 is India’s first Central law exclusively enacted to prevent paper leaks, organised cheating and examination fraud in notified public examinations.
    • It was enacted on 12 February 2024 and came into force on 21 June 2024 under the Ministry of Personnel, Public Grievances and Pensions
    • Before 2024, India had no dedicated Central legislation to address paper leaks. The Act fills this legal gap.
  • Features: The Act covers examinations conducted by UPSC, SSC, Railway Recruitment Boards (RRBs), IBPS and the National Testing Agency (NTA). The Central Government may notify additional examination authorities through the Schedule.
    • The Act recognises numerous unfair practices, including question-paper leaks, answer-key leaks, impersonation, hacking, tampering with computer resources, fake websites, fake admit cards and manipulation of merit lists for wrongful gain.
    • This Act specifically defines organised crime involving collusion among multiple persons for monetary or wrongful gain. It enables authorities to prosecute complete criminal networks.
    • The law extends liability to printing agencies, technology firms, logistics providers, examination centres and outsourced service providers engaged in conducting examinations. 
    • The law enforces strict prison terms of 3 to 5 years for individuals and up to 10 years for organized crime groups, alongside heavy financial fines.
    • It explicitly criminalizes 20 distinct offenses to tackle modern threats like impersonation, OMR sheet tampering, and illegal network access.
    • The Act declares offences cognizable, non-bailable and non-compoundable, enabling prompt police action in serious examination fraud cases. 
    • It also authorises investigation by officers not below the rank of DSP/ACP
    • It permits attachment and forfeiture of property derived from organised examination fraud through amendments linked to the Criminal Law (Amendment) Ordinance, 1944.
    • A new National Technical Committee is mandated to create secure IT protocols and protect the digital integrity of computer-based examinations.
